Section 322 in Part 9 creates a general definition of theft, while other sections such as section 326 (which deals with the theft of gas, electricity and telecommunication services) define special kinds of theft. According to the general definition in section 322 a person steals a thing if he or she takes or converts it fraudulently, without colour of right and with intent to deprive the owner of it, either permanently or temporarily. For the purposes of punishment theft is divided into two separate offences by section 334 depending on the value and nature of the goods stolen. If the thing stolen is worth more than $5000 or is a testamentary instrument the offence is commonly referred to as Theft Over $5000 and is an indictable offence with a maximum punishment of 10 years imprisonment. Where the stolen item is not a testamentary instrument and is not worth more than $5000 it is known as Theft Under $5000 and is a hybrid offence, meaning that it can be treated either as an indictable offence or a less serious summary conviction offence, depending on the choice of the prosecutor. If dealt with as an indictable offence Theft Under $5000 is punishable by imprisonment for not more than 2 years and, if treated as a summary conviction offence, 6 months imprisonment, a fine of $2000 or both. |

Free tans to people put in as Employee tans, even on Robs profile and employee's profiles that don't work for us anymore. she had some bullsheit excuses that the timer system went funny, and to fix it she shut if off, and all the beds shut off so she'd restart them using ET code on Employee profile. lol but we all know that beds don't shut off if you unplug the Tmax. but today, my girl cracking the whip in there stumbled across a girl booked, highlighted that she tanned, bought a lotion packet on her profile, but no tan, but at that exact time, in the exact bed, a ET tan was put on an employee's profile, who happend to be on vacation then, and so My girl confronted her and said lets see if this happens every time she buys a packet. sure enough. All using the same employee's code. computer doesn't lie. this has been going on since May just with this one person. and we saw plenty of questionable things, all done by this girl. Almost always, tans in the HP unit. Drop ins are worth $35. so we will add them all up and see what we get! Stupid girl. And I told her that the program records every keystroke. __________________ We are the creators of our own life experiences through thought. Thought becomes things, good or bad. Think positive. | Moderator | For fans of cameras. This was yesterday and found it today and had the cops come arrest her this afternoon. Cameras still won't deter the stupid ones. DropShots.com __________________ . |

| Moderator | First they do know cameras are there, and that I watch from home regularly. They know they record also, but guess they think I don't rewatch(which most of the time I don't, not enough hours in the day). I was out of town and I'm sure she knew I wouldn't be watching. The person she tanned in the video was right after the one who did mystic who she didn't ring up and tanned under one of my all access clients. She just happened to snag the cash after she sent the next one in line to tan. She was texting her boyfriend in the video, who showed up 10 minutes later to pick up the cash. The cop wouldn't arrest him, as she said he didn't know where the money came from ![]() __________________ . |

Maybe you can charge the customer but then you wouldn't be able to get the money back from your employee. You can't recover your damages twice. I would also think you would only be able to charge the customer if you were positive they knew what was going on was wrong. Like it was your employee's friend or relative or something and they knew that the employee was not charging them but wasn't allowed to do that. Otherwise the employee could tell the customer that they earned the free tan somehow. |
