| Boone man says he was burned in tanning bed 5/25/2007 7:45 AM By Cara Bailey -Kanawha Bureau CHARLESTON - A Boone County man has filed a suit against a local tanning salon, claiming he was seriously burned while laying in one of the beds. Dennis Wheatley filed a suit May 2 in Kanawha Circuit Court against Planet Tan of Charleston. Wheatley claims he went to the salon on May 18, 2005, and asked about the procedure, timing of the beds, and how long he should lay. An employee "negligently" told him be in the tanning bed for up to 20 minutes, the suit says. Wheatley claims that after 10 to 12 minutes in the bed, he felt his skin burning. After 15 minutes he climbed out of the bed, the suit says. "Over the next few days (Wheatley) experienced major burning, nausea, vomiting, and severe pain associated with the burns," the suit says. Wheatley claims the pain was so bad he went to the emergency room. He claims the salon was negligent in their practice of informing the clients of the correct process of tanning and in doing so, breeched its duty to a customer. Wheatley seeks damages for lost wages, pain and suffering, injuries, medical bills and emotional distress. Attorney Roger Forman is counsel for Wheatley, and the case has been assigned to Judge Louis Bloom. Kanawha Circuit Court case number 07-C-865 Source |

So i changed to reflectors. I'm happy now. I saw a fat chick walk by today.....can i sue her for emotional distress and the fact that my hard on went limp because of her? And what kind of lamps in a 20 minute bed would burn someone so bad they were vomitting and needed hospitalization after 10 minutes? Just sounds a tad unrealistic. Granted we skin type and know whether you're a type I and should be quickly ushered out of the place. But I mean, even ghastly pale people come in and do 6 in our 20s w/o too many issues. An added 4 would definitely burn them, but for cryin out loud. I wonder if he spent the day outside first and then added to it in the tanning bed. That description above is definite sun poisoning. I had "one of those" come in yesterday red as a lobster. The counter girl called me out of the office to see her. She was so red as soon as I saw her I started shaking my head. She said "I'm not burned I'm just hot because I've been outside in the sun all day" I was like...looks like a burn, a pretty bad one. She also mentioned she was trying to hurry and get in for her white wedding dress tomorrow. Even though Panther Cheatah HiTans (frybaby 10 min Te) stuck in a 20 min bed would cause sunburn in 10-15 minutes... the guy is LYING. You can not "feel" sunburn until at least 8 hours after the exposure. He probably had prior sun exposure and some kind of UV-sensitive medications too. | |

Skin tightening, pins & prickle feeling, overheating from the inside out, those are my warning signs I'm about to get pink. And there have been times I've felt it within a few hours... last night I added a minute to my tan time at 6:30pm, by 10 I could feel my cheeks getting hot and tight. Today, lookit that, they are a wee bit pink... |

I've had tons and I mean tons of people say they can tell when they were burning. But its not after 10 minutes, they felt a "sun poisoning" type burn that requires hospitalization. Which brings me to another point, doesn't the story say he felt his skin burning at 10 minutes and then at 15 minutes he decided to get out of the bed? WTF? Uh if admittedly you feel a burn coming on and you stick it for another 5 mins...you're either a moron or you were intentionally trying to burn to "get a little more" that day..in which you have no business suing anyone.
