State sues tanning salon operators

Business First of Columbus - 4:18 PM EDT Tuesday, June 26, 2007



After receiving more than 140 complaints about area Hottie Body tanning salons, the Ohio attorney general has sued the company's owners in Franklin County Court of Common Pleas.

Attorney General Marc Dann said Tuesday the lawsuit was filed against Charles and Dana White and alleges violations of the state's Consumer Sales Practices Act, which protects against unfair or deceptive sales.


"Our investigation found that Hottie Body continued to sell tanning packages while knowing they were financially unstable and would not be able to fulfill the services paid for," Dann said in a release.

Consumers' complaints typically were about the company's salons being closed and accusations it refused refunds for services it didn't provide, the state said.

Dann is seeking restitution for consumers in addition to a permanent injunction against the company and civil penalties.
The Hottie Body franchise ran nine salons in Central Ohio.

St. Louis tanning salon chain Tan Co., which reported $30 million in sales in 2006 and is unrelated to Hottie Body, in May acquired three former Hottie Body salons that had closed.

Hottie Body and Tan Co. representatives could not be reached for comment.

"Lawsuit" sounds civil, not criminal. No debtors prisons anymore.

That, if proven, can turn into criminal charges. FRAUD is criminal. Oh, how the plot thickens.
