I have an employee who has been working for me for almost 3 years. I have suspicions she is stealing, she broke my computer so currently everything is just through the T Max. She complains she does not get breaks, although manages to smoke almost a whole pack of cigarettes while working. I have two tanning salons and I work 6 days between the two, and have one employee to work at each salon. Yesterday the register was exactly $75 off, and when I confronted her, she said she thought something was funny with the register. I was like "huh"? I am sort of a softie as a boss, and she is 10 years older than me, and I do have cameras but can not see where the $75 went. Obviously I would not steal from myself, but she actually told me to watch the camera video and I would see myself taking the money, which I did not! How can I politely let her go after this incident? Any advice is greatly appreciated! She is the type if I do something harsh, she would try and sue me!

Is she on payroll or are you paying her under the table? Makes a big difference. If you're paying her under the table she could cause all kinds of hurt for you.
If she's on the payroll, just tell her she's fired for stealing. She won't be able to collect unemployment and it's her word against yours. You told her the drawer was short, she agreed and said you did it. Watch the cameras. If the cameras clearly show it wasn't you, you've got nothing to worry about. Or, you could just lay her off. But then she'll be able to collect. I say you set her up on camera to GET her to steal. Then you've got proof and she has no case and no unemployment. |

and if she's actually smoking a whole pack of smokes on a daily basis, she's taking too many unauthorized breaks and she's clocked in while doing it. That's grounds for termination with no unemployment benefits.

Don't fire her for stealing if you don't legitimately can't see it on the camera- then she will sue you- and probably win.
Just let her go (for whatever reason), let her collect unemployment. If you are a softie, I will assume that if you have no documentation of previous issues with her that would include her signature. |

I would check with your state/province laws when it comes to letting people go. Or if you have a labor board you can call, I would ask them what to do in that situation. You have to be so careful sometimes when it comes to that stuff.

You should be able to fire her for taking unauthorized breaks while clocked in. If nothing else I would at least get someone else hired ASAP (if needed) and drastically cut her hours. If she is currently working 30 hours/week, cut her down to 10. When she asks why just tell her that you need additional people at the salon and in order to bring them in you need to cut her hours to give them some hours. She most likely won't like it and quit. If that doesn't work I would make sure to start documenting anything and everything that she does so that you do have grounds to fire her.
Most people aren't going to sue you for firing them. It costs too much money and takes too much time to sue someone. I really wouldn't worry about that. I would, however, want to make sure you have reason to fire her (if required in your state) so that she can't collect unemployment. Our state is an Employment At Will state, meaning I can fire someone without any particular reason as long as it isn't based on sex, race, religion, nationality, etc. You really should check into your state laws. |

It is as simple as telling her you no longer need her services. Busy Season is OVER and you are going to have to work the hours yourself in order to keep your doors open
